So we replaced our roof last June. Checked the contractor out, no complaints or anything against them. They were in business for 6 years. I called and asked them for a lien waiver when they were done and they kept telling me one was in the mail. Well we finaly got a letter from the supplier stating they were putting a lien on our house unless they paid for the materials (1600 worth). We filed a complaint with the BBB as well as a police report for contractor fraud and got that taken care of, but today I came home from our tournament to have my husband point out at least two places in the garage alone that the roof is leaking (it's finaly warm enough where the snow is melting). The contractor went out of business. What do I do about myfreaking roof? It was supposed to have a warranty on it but obviously they aren't going to honour it.
Any advice or suggestions on what to do about this damned roof and shitbag contractor?

Well they are out of business that's the bad part. You'll have no other but to get another contractor to fix your roof and maybe suit the other contractor to pay the new bill since it is under waranty.
Call the mnufacturer of the shingles (if thats whats leaking) and have them tell you a company to use that they reccomend. Then have them send the bill to the now out of business company and see what happens. This is why I do all of my own work for myself, I'll never go out of business cause I don't charge myself.

That's really unfortunate, but probably true. If they went out of business, it's going to be very difficult to do anything. Hell, you can't even smudge their reputation. They're gone. If you decide to sue, even in small claims court, you'll have to put some money up front to cover court costs. There's no guarantee that you'll ever get that back. If the contractor who initially did the work was a corporation, you'll have to sue not only the corporation, but the president and other officers of the corperation as well. Another thing to consider is how much time, as well as money, you're willing to spend on this. I'm not at all familiar with the court system where you live, but here in Ohio, you'd likely have to take time off work, (if you're working days), to file the suit. After that, it could be several months before the case comes to court. All this time, your roof is still leaking.
I'm not trying to discourage you in any way, but as a former business owner, I'm just relating what my experiences have been. You alone have to weigh the costs, and decide if it's worth while. I know you're outraged, as I would be. If it were me, I'd try to be careful not to cut off my nose to spite my face.

Try contacting the local TV stations. Around here they have a help line that puts the glare of the media on them. I dont know how much good it will do since they are out of business, but the contractor may have a change of heart if the media shows up in his yard trying to get information and ask them why the roof is leaking and so forth. Its at least a shot, and if it works you arent out any money.

I wanted to do the roof myself, but we have such a tall and steep pitch, it just wasn't safe or practical.
Since they were hard to get to pay for even the materials used for the roof, I have a hard time seeing how they'd pay for anything else. I am going to try to call the contractor tomorow tosee what he says and file another report with the BBB.
The leak is the same place that it was leaking BEFORE the roof was replaced! (and yes I know it was stripped down to the wood and replaced I was here and supervised the entire job). My poor husband. We spend 4500 so he doesn't get rained on in his garage only to be rained on in his garage.

If the shingles were installed properly and they leak the manufacture of the shingles will have to replace them, at no cost to you.
If they were installed wrong it's the contractors job to replace them.
If the contractor is out of bussiness then you might be able to get a suit against them, other than that there is little else you can do.

Quite honestly, they left me an extra set of shingles because I was going to attempt to build a doghouse, so I have extra shingles. I'm just pissed off about having to even deal with this after everything we've been through with them so far. It's going to have to wait to get fixed until it warms up a little though. The weather is so damned unpredictable here right now. It was 50+ yesterday and hailing/snowing/sleeting here today with a wind chill of about 10.

dude, did you even read my post? If the roof wasn't so steep I WOULD have done the damned thing myself. I'm not afraid to do things like that, but I do want to keep myself safe also. Not to mention I didn't have anyone that was willing to help. Have you ever roofed a 1600 square foot two story house with a 9/12 pitch by yourself before?
Now that I HAVE paid for it, hell yeah I want them to fix their work. That's what I paid them thousands of dollars for, isnt it?

Even if the business is out of business, the owner is liable for shoddy work. They offered you a warranty and they've broken a contract. Go to your states Attny General's website and find out how you file a formal complaint against the company's former name and the owner of the now defunct business. They will persue this for you for no cost and/or give you your legal recourse.
As for having the repairs done. If your Attny General says they can prosecute I would also ask them to get the funds to repair.
It's obvious why they went out of business. stupid asses.
Consumers have protection, you just have to keep your nose to it to see it through. You'll be ok - just fight these idiots.
